Fulfilment of terms for commencing the realisation of the order for the RWE-VGT-KEM power station in Lingen

Further to current report No. 65/2009 of 8 December 2009 on the order placed by the German firm G+H Schallschutz GmbH of Ludwigshafen for Energomontaż-Południe S.A. (the Issuer the Company) to supply the vertical sections of exhaust flues for the RWE VGT-KEM power station in Lingen Germany the Issuer's Management Board declares that on 3 February 2010 it received news of the fulfilment of the condition upon which the launch of the above project was dependent.

Further to current report No. 65/2009 of 8 December 2009 on the order placed by the German firm G+H Schallschutz GmbH of Ludwigshafen for Energomontaż-Południe S.A. (the Issuer, the Company) to supply the vertical sections of exhaust flues for the RWE VGT-KEM power station in Lingen, Germany, the Issuer's Management Board declares that on 3 February 2010 it received news of the fulfilment of the condition upon which the launch of the above project was dependent. The condition was the positive conclusion of an audit by the main project investor, RWE Power AG of the Issuer's production unit - the Industrial Production Plant (Zakład Produkcji Przemysłowej) in Będzin Łagisza. The value of the order is approximately EUR 1.3 million which is approximately PLN 5.2 million according to the median exchange rate of the National Bank of Poland on the date of publication of this report. The order will be completed by August 2010.

The maximum penalties set forth in the order do not exceed 10% of its value.
G+H Schallschutz GmbH belongs to the VINCI Energies group, with whom the Issuer has renewed cooperation.

Taking the above order into account, the Company's order of portfolios has an estimated value of approximately PLN 369 million (this includes export orders worth approximately EUR 59.7 million). The value of the portfolio was calculated according to the euro exchange rate used by the Issuer to calculate orders.
